Terms and Conditions


Agreement
This agreement between Nilfisk, Inc., Industrial Vacuum Division, and the Buyer incorporates all terms from www.nilfiskcfm.com. These terms supersede any other agreements unless expressly agreed to in writing by Nilfisk, Inc.

Product Quotation Disclaimer
Nilfisk recommends equipment based on customer requests and assumes no responsibility for compliance with OSHA, NFPA, or other regulatory standards. The buyer is responsible for ensuring the vacuum equipment is suitable for its intended use, as determined by the buyer's Authority Having Jurisdiction (AHJ). Compliance with the NFPA guidelines does not guarantee approval for use in hazardous locations.

Prices
Prices exclude taxes, which will be added where applicable. A monthly service charge of 1.5% may apply to overdue accounts.

Force Majeure
Nilfisk is not liable for delivery delays due to circumstances beyond its control, including natural disasters, strikes, material shortages, or government directives. Nilfisk is not responsible for any damages resulting from such delays.

Delivery Terms
All shipments are FOB Shipping Point unless otherwise stated. For FOB Destination shipments, inspect products within five days of delivery to file any damage claims with Nilfisk. For FOB Origin shipments, the customer is responsible for filing damage claims.

Inspection and Acceptance
The buyer must inspect goods and report any defects, damages, or shortages within 10 days of delivery. Failure to do so will be considered acceptance of the goods, waiving any claims.

Warranty Administration
Warranty claims are handled by Nilfisk's factory. Nilfisk may choose to replace parts or equipment, or request the return of goods. Returns require a Return Authorization Number (RAN). Contaminated equipment may not be accepted. Shipping costs to the factory are the buyer's responsibility, but return shipping is covered if the claim is approved.

Warranty
Nilfisk warrants its industrial vacuum equipment to be free of defects in workmanship and materials for two years from the delivery date. If a defect is found, Nilfisk will repair or replace the faulty part. The buyer is responsible for all shipping costs. This warranty does not cover normal wear and tear, misuse, or unauthorized repairs. Non-OEM parts used in repairs are not covered.

Limitation of Liability
Nilfisk disclaims all other warranties, including implied warranties of merchantability and fitness for a particular purpose. Nilfisk is not liable for indirect, incidental, or consequential damages, such as lost profits or production downtime. Liability is limited to the price of the equipment or part involved in the claim.

Changes
Once accepted, the buyer's order cannot be canceled or reduced without Nilfisk's written consent.

Applicable Law
This agreement is governed by the laws of Minnesota, and disputes will be resolved in Minnesota courts.

Waiver
Failure to enforce any provision does not constitute a waiver of Nilfisk's right to enforce it in the future.

 

Filing a Claim

To file a claim, simply submit the form. We may request photos or videos for verification. Since most claims are minor, let us assist you before proceeding.

Repair and Shipping Costs

If a repair is required, the customer is responsible for return shipping, including proper packaging and insurance. Claims for lost or damaged items must be filed with the shipping carrier. Shipping costs for replacement parts are the customer's responsibility unless waived.
